Non-profit status
There appears to be some concern from some members about where it states that ITC in Australia is a nonprofit organization. There are two points which currently enforce the non-profit status of ITC in Australia.
First, the Australian Region, which includes all members, clubs and councils, is incorporated under the Associations Incorporation Act NSW (1984). This is a different piece of legislation from the Incorporations Act which covers all companies, including companies which make a profit. The Associations Incorporation Act NSW (1984) is only for the incorporation of non-profit organizations. Such organizations include community sporting clubs that are non-profit, community organizations and, of course, ITC. An organization cannot be incorporated under the Associations Incorporation Act NSW (1984) unless it is a non-profit organization. If the organization wishes to make a profit then it must be incorporated under the Incorporations Act. Secondly, the International Articles of Incorporation state that ITC is a non-profit organization. See the International Articles of Incorporation II a. The Region by laws state that these by laws may not be in conflict with International by laws. See Region by law 16.1.
